Phyllis A. Engleson, a North Dakota resident, brought a diversity action against the City of Little Falls, Minnesota, and the Little Falls Area Chamber of Commerce (collectively the City), alleging the Citys negligent placement of traffic cones at the Little Falls Area Arts & Crafts Fair had caused her to trip on a cone and sustain personal injuries. The district court entered summary judgment for the City, concluding it was not under a duty to warn fair goers of the presence of safety markers and in any event enjoyed discretionary immunity under Minnesota law.
