Order This appeal came before a special panel of this court on plaintiff's motion for a stay pending hearing and decision by the District Court on plaintiff's motion for preliminary injunction filed in the District Court, or the alternative a stay pending appeal. The issues contained in the motion are the same as those raised on appeal and the parties have filed briefs and argued orally. The court therefore treats the appeal as submitted on the merits. The appeal challenges the order of the District Court denying extension of a previously issued temporary restraining order and setting for hearing on June 1, 1981 the plaintiff's application for preliminary injunction.
